Please read these Terms and Conditions carefully before using the Narwhal Music website and placing an order. By accessing our website or placing an order, you agree to be bound by these terms.

1. About us

Narwhal Music (“we”, “us”, “our”) operates the website at narwhalmusic.co.uk. We are a music collective selling physical and digital music products and related merchandise. References to “you” or “your” mean the customer placing an order or using our website.

2. Placing an order

By placing an order through our website, you confirm that you are at least 16 years of age, or that you have obtained parental or guardian consent to make the purchase. You confirm that all information provided during checkout is accurate and complete.

All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order at our discretion, including where a product is listed at an incorrect price due to a typographical error or system fault. In such cases we will notify you promptly and provide a full refund.

A contract between you and Narwhal Music is formed only when we send you an order confirmation by email. Until that point, no binding contract exists.

3. Pricing and payment

All prices displayed on our website are in pounds sterling (GBP) and include VAT where applicable. Prices may be subject to change without notice, but changes will not affect orders for which you have already received a confirmation.

We accept payment via the methods displayed at checkout. Payment is taken at the time of ordering. All transactions are processed securely and we do not store your full payment card details.

4. Shipping and delivery

We aim to dispatch physical orders within two working days of receiving payment. Delivery timescales are estimates only and we cannot guarantee delivery on a specific date. We are not liable for delays caused by third-party couriers, customs processes, or events outside our reasonable control.

Risk in the goods passes to you on delivery. Title to the goods passes to you on receipt of full payment.

International orders may be subject to import duties and taxes levied by the destination country. These charges are your responsibility and we have no control over them.

5. Digital downloads

Digital download products are made available immediately on receipt of payment. By purchasing a digital product you acknowledge that your right of withdrawal under consumer regulations does not apply once you have downloaded or streamed the content, in accordance with applicable law.

Digital products are licensed for personal, non-commercial use only. You may not redistribute, resell, or make available to third parties any digital content purchased from us.

6. Returns and refunds

You have the right to cancel a physical goods order within 14 days of receiving it without giving a reason, in accordance with the Consumer Contracts Regulations 2013. To exercise this right, notify us at hello@narwhalmusic.co.uk within the 14-day window.

Returned items must be in their original, unopened condition. We will process your refund within 14 days of receiving the returned goods. We will refund the original purchase price plus standard delivery charges. You are responsible for the cost of return postage unless the item is faulty or was sent in error.

Faulty or damaged items should be reported to us within 30 days of receipt. We will arrange a replacement or full refund including return postage at our cost.

7. Intellectual property

All content on this website, including but not limited to text, images, logos, and design elements, is the property of Narwhal Music or is used with permission. You may not reproduce, distribute, or create derivative works from any content on this site without our express written consent.

Music, recordings, and artwork remain the intellectual property of the respective artists and labels. Purchase of a physical or digital product does not transfer any copyright or intellectual property rights to you.

8. Limitation of liability

To the maximum extent permitted by law, Narwhal Music shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or products. Our total liability to you in connection with any order shall not exceed the value of that order.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

9. Governing law

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

10. Changes to these terms

We may update these Terms and Conditions from time to time. The current version will always be available on this page. Continued use of our website following any changes constitutes your acceptance of the updated terms.
